26 Chait, Kathmandu. Former Prime Minister and UML President KP Sharma Oli and former Home Minister and Congress leader Ramesh Ukhtar have been released from custody on Thursday after 13 days.

Oli, who was being treated at the Terti Teaching Hospital in Maharajganj, was handed over to his family by the police at the hospital. On the other hand, the writer, who was kept in No. 2 Gana Maharajganj of the police, was also left in the custody of his relatives.

Ramesh Thapa, SSP of District Police Complex, Kathmandu, said that they were released on their appearance. SSP Thapa said to Online News, “We have given the responsibility of relatives to attend on the condition that they will be present when called.”

Oli, what will happen to the process of their case now that the writer has left? Are they missing because of lack of evidence? Such questions have arisen. But the SP of the premises Pawan Kumar Bhattarai says that the investigation will continue.

As SP Bhattarai said, it is not that they are missing in the case where the case is not registered due to lack of evidence. On March 23, due to the order given by the bench of Supreme Court Justices Vinod Sharma and Sunil Kumar Pokharel, Oli-Lekhak was released.

According to the premises of the investigation about Oli-author, initially, the report recommending action by the Commission was studied. After studying the report, the police officials say that they are going to gather facts about the allegations against them.

While hearing the writ of habeas corpus filed on behalf of Oli-author, the bench of judges Sharma and Pokharel said that the investigation should be completed within 26th.

The Supreme Court had given an order that if the investigation is not completed within 26th, he will be released from custody.

The Supreme Court said, ‘Oli and the author should complete the procedure of the Criminal Procedure Code, release them from custody and complete further investigations.

Even the order of the Supreme Court did not stop them from investigating. Instead, he said that he could do the investigation quickly.

According to this order of the court, the police could not submit the case to the public prosecutor’s office after completing the investigation within 26th. ‘There was still a lot of work needed for the case. We were in the process of gathering all those facts. All this work was not possible within the 26th,’ said an officer of the complex.

After it was not possible to submit the investigation report within 26th, the release process of Oli and the author was started. The police released them from custody after the public prosecutor’s office gave a letter to the premises of Kathmandu with the decision to release them on bail only on Thursday.

Now the police will not be quick to explain this case. As both the arrested defendants have been released from custody, the police have been relieved of the obligation to submit the case within 25 days.

Since it is a case of death and both defendants are free from custody, there is no limit to submit the case. Due to this, there is no legal obligation to register a case against Oli-author immediately.

What happened to the investigation?

On the morning of 14th March, Oli-Lekhak was arrested from his residence in Bhaktapur. But the responsibility and jurisdiction of all the work of the case process was in the District Police Complex Kathmandu.

Then they were brought to the premises in Kathmandu. Oli was admitted to the hospital due to health problems. The writer was placed in Maharajganj number 2 Gana.

During their 13-day detention, the issue of what the police investigated for the crime related to death is being watched with interest.

According to the premises of the investigation about Oli-author, initially, the report recommending action by the Commission was studied. After studying the report, the police officials say that they are going to gather facts about the allegations against them.

After studying the report, the police took the statement of Oli and the author in the presence of the government lawyer. He made a statement saying that the issue of riot control is not the Prime Minister’s jurisdiction.

The decision to implement this recommendation of the Karki Commission was made by the Balen Shah-led Council of Ministers. Then they were arrested.

The complaint from the side of the deceased and the victim’s family have also been interrogated about the incident.

The document of the incident caused by the injured will also be included in the evidence. The nature of the scene related to the incident has been covered by bond, physical examination bond, post-mortem report and bond.

It is said that the bonds and evidence collected in the past will also help in the investigation.

Even though they have been released from custody, the investigation is still going on, says Pawan Kumar Bhattarai, SP and spokesperson of the premises.

‘They have been released on the condition that they cooperate with the investigation and attend when called. The work of investigation does not stop,’ says SP Bhattarai.

What is left?

The police have not submitted the investigation report to the public prosecutor’s office saying that the investigation is still pending.

There is still work to be done to identify the person related to the incident as an accomplice, get documents, document the incident details of the doctors involved in the treatment, etc.

According to the police, matters such as how the shooting came to be, who’s role was there, and what orders came from whom, are yet to be investigated.

What is the issue?

On 23 and 24 August, Oli was the Prime Minister and the author was the Home Minister during the Genji movement. On August 23 alone, 21 people were killed, 19 in Kathmandu and 2 in the outer districts due to firing by security personnel.

Including 24 August, 76 people died. A commission was formed under the leadership of former judge Gauri Bahadur Karki to investigate this incident.

In the report submitted by the Karki commission, Oli-author was found guilty and recommended for action.

Oli and the author were recommended to take action according to Sections 181 and 182 of the Civil Code. In Section 181 of the Civil Penal Code, there is an offense that ‘no one should kill someone by negligent act’.

They were accused of using force in the Genji movement of 23 August and not trying to stop it.
